JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Patrakar Nagar P.S. Case No. 600 of 2017, dated 11.11.2017, instituted for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code.

The informant and others are alleged to have been cheated at the instance of the staff and officers of a bank which was being run under the name and style of Central Bank Staff Co-operative Limited. It has been alleged that the petitioner represented himself as an agent of the

Patna High Court Cr.Misc. No.33622 of 2018 (3) dt.03-07-2018 2/3 aforesaid bank and had convinced the informant for depositing money in a recurring deposit scheme. Believing the statement of the petitioner, money was deposited through the petitioner. For such deposit, receipts were also given to the informant, but later, it was found that the staff of the bank had closed down the building and had run away. Learned counsel for the petitioner has submitted that as an agent of the aforesaid bank, he collected money from the investors and deposited it in the bank. Later, the officers and the persons responsible for running the bank played truant and ran away.

In fact, even the salary/commission of the petitioner has not been paid. Whatever amount was collected by the petitioner has been deposited in the bank. For the closure of the bank, the petitioner cannot be held responsible.

It has further been submitted that the other accused persons including the functionaries of the bank have been granted the privilege of anticipatory bail by this Court. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned
