Petitioners seek bail in connection Chauri P.S. Case no. 91 of 2020 registered for the offence punishable under sections 304B and 201/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners are in custody since 30.10.2020 and petitioner no1 is father-in-law and petitioner no.2 is brother-in-law of the deceased. He further submits that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that his daughter was married to Deepak Singh in the year 2015 and after marriage demand of dowry started whereafter it is alleged that deceased came back to her father's

Further while deceased was at the house of the informant she came to know that her husband Deepak Singh had married to sister-in-law of his younger brother (Ravi Shankar Kumar) petitioner no.2. It is further alleged that on 29.10.2020 informant instituted this FIR on coming to know that dead body was lying near Bandh near Sone river and when he along with villagers went there he saw the petitioners and Deepak Singh and on seing the informant with villagers, they fled away thereafter, body of the deceased was taken out from river. It is further alleged in the FIR that 08 days prior to 29.10.2020 daughter of the informant was missing.

Learned counsel for the petitioners submits that from perusal of the allegation as alleged in the FIR, it would manifest that informant specifically alleges that his daughter was missing about last 08 days but he remained silent and he did not institute any case relating to missing of his daughter. Further, learned counsel submits that allegation that Deepak Singh married sister-in-law of petitioner no.

Patna High Court CR. MISC. No.33041 of 2021(4) dt.30-11-2021 3/3 implicated by robing them with allegation that when the informant reached near river Sone, he saw the petitioners along with Deepak Singh fleeing as such it is alleged that it was the petitioners who killed the deceased.

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioners are father-in-law and brother-in-law of the deceased and charge sheet has been submitted, the petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mrs. Suman Kumari, Judicial Magistrate, Ist Class, Bhojpur at Ara in Chauri P.S. Case no. 91 of 2020.
