This application for grant of regular bail arises out of Daniyawan P.S. Case No.294 of 2023 registered for the offence punishable under sections 341, 323, 354, 379, 302 and 120-B of the Indian Penal Code and under section 27 of the Arms Act.

The petitioner, who is 75 years old, is alleged to have assaulted the victim and killed him by electrocution for monetary dispute.

It has been submitted by learned senior counsel for the petitioner that the deceased was drunk and in drunken condition he got electrocuted and when the petitioner

Patna High Court CR. MISC. No.17075 of 2024(3) dt.08-05-2024 2/2 tried to save him he has been made accused in this case. It has also been submitted that the petitioner is in custody since 06.11.2023 having clean antecedent.

Learned counsel for the informant has opposed the prayer of the petitioner for bail. 6.

Considering the submission of learned counsel for the petitioner, the age of the petitioner and also the fact that he has clean antecedent, this bail application is allowed. 7.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna City, Patna/ concerned court, in connection with Daniyawan P.S. Case No.294 of 2023, subject to the condition that he will cooperate in the trial.
