JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-05-2022 Heard Mr. Vinay Kumar Mishra, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Ram Krishna Nagar P.S. Case No. 199 of 2020 dated 06.07.2020 instituted for the offences under Section 364 of the Indian Penal Code.
The wife of the victim has alleged that while she along with her husband had gone to the house of a common friend, her husband was abducted. Later, the abductor called on the mobile telephone of her husband and of the friend, where the informant along with her husband had visited and demanded money intimating that if the money which was taken by the victim for providing employment to the abductor would be

The learned counsel for the petitioner has submitted that from the averments made in the FIR itself, it would appear that it is a clever strategy of the wife of the so-called victim to protect him from being prosecuted in a case of maliciously defrauding people for providing appointment to them after realizing money. The victim has returned but has not made his statement under Section 164 Cr.P.C.
So far as the petitioner is concerned, the learned counsel for the petitioner has submitted that he has been named by one of the co-accused persons of this case viz. Praveen Kumar, who had some animus as he had also given some money to the victim for procuring employment but neither employment was given to him nor money was returned. The petitioner though has been named by aforesaid Praveen Kumar but it has come during the investigation that the petitioner also had given money to the victim for procuring appointment. It thus appears that the victim was held back for some time for the purposes of realization of the amount, which he had fraudulently taken from very many persons desirous of obtaining Government job.
Be that as it may, since the name of the petitioner has

No.25723 of 2021(2) dt.26-05-2022 3/3 transpired only in the confession of Praveen Kumar, who too has filed a case against the husband of the informant and taking into account that the husband of the informant has come back home, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-cumAdditional Chief Judicial Magistrate-XIII, Patna in connection with Ram Krishna Nagar P.S.
