JUSTICE MADHURESH PRASAD ORAL ORDER 09-05-2018 Instant modification petition has been filed for modification in order no.3 dated 6.4.2018, passed in Cr.Misc.No. 12916 of 2018 by which all the three petitioners have been granted regular bail in Bhadurpur Police Station Case No. 485 of 12017.

It is submitted by learned counsel for the petitioners that the relatives of the petitioners are not available in Darbhanga, as such, they have not furnished bail bond till date in compliance of condition no. 1 of the bail order dated 6.4.2018. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent and even no seizure list has been prepared in the instant case.

In view of such submission as also considering the fact that the petitioners have no criminal antecedent and they are in custody since 19.11.2017 for offence under sections 406 and

No.28905 of 2018 (2) dt.09-05-2018 420 IPC and no seizure list was prepared in respect of recovery from the petitioners, this Court is inclined to modify the condition no. 1 of bail order dated 6.4.2018 to the extent that "one of the bailors will be a local resident in place of a close relative of the petitioners".
