JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 21-03-2025 In the instant petition, petitioner has prayed for the following relief(s):- i) For issuance of writ in the nature of mandamus, directing upon the respondent authorities to grant the compensation amount (Award) of the rest part of the land i.e. Area 10.25 Decimal of Mauza-Basudevpur, Thana No.449, Khata No.446 (New), Khesra No.2645 (New), which has been acquired for the project of Extension of Civil Enclave of Darbhanga Airport since the respondent authorities have acquired the total area of land belonging to the petitioner is
Patna High Court CWJC No.4144 of 2025(2) dt.21-03-2025 2/3 39.25 Decimal but as per L.A. Case No.78/2021-22 under Award No.125, compensation has been given to the petitioner for only the area of 0.29 Acre (29 Decimal) for which petitioner raised objection before the authority and upon his objection authority sought report from the Circle Officer, Sadar, Darbhanga and thereafter, the Anchal Ameen after demarcation/ measurement of the said area of acquired land submitted his report in favour of petitioner's contention but till date no further action has been taken by the competent authority.
ii) For issuance of writ in the nature of mandamus, directing the commanding upon the respondent authorities particularly Respondent No.5 i.e. The District Magistrate-cum-Collector, Darbhanga for taking the decision upon the application/ representation dated 06.12.2024 given by the petitioner for requesting to grant compensation for the rest part of land i.e. 10.25 decimal in view of the report of Anchal Ameen dated 14.06.2024, wherein it has been clearly stated that the said acquired land under the Mauza-Basudevpur, Thana No.449, Khata No.446 (New) & 17 (Old), Khesra No.2645 (New) & 1747 (Old) is 39.25 Decimal.
2. Learned counsel for the petitioner submits that in view of the order dated 11.11.2024 passed by Co-ordinate Bench of this Court in C.W.J.C. No.16915 of 2024 he filed representation before the District Magistrate-cum-Collector, Darbhanga, respondent no.5 for redressal of his grievance vide representation dated 06.12.2024. He further submits that this case may be disposed of with direction to the respondent no.5 to
Patna High Court CWJC No.4144 of 2025(2) dt.21-03-2025 3/3 dispose of his pending representation dated 06.12.2024 expeditiously.
3. Learned counsel for the State has no objection to this prayer of the petitioner.
4. In view of the submissions of learned counsel for the parties, the present writ petition stands disposed of with direction to the respondent no.5 to expedite the disposal of pending representation of petitioner dated 06.12.2024 preferably within three months.
