JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-04-2021 The present petition has been filed for restoration of a petition bearing Criminal Misc. No. 79953 of 2019 which has stood dismissed on account of non-compliance of peremptory order dated 19.12.2019.

The learned counsel for the petitioner has submitted that on account of certain difficulties, the defects could not be removed within time, however, they have been removed subsequently, hence a lenient view may be taken inasmuch as the petitioner is languishing in custody since a long time. Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner as also taking into account the averments made in the present petition, I deem it fit and proper

Patna High Court CR. MISC. No.21229 of 2021(2) dt.07-04-2021 2/2 to direct for restoration of the aforesaid Criminal Misc. No. 79953 of 2019 subject to removal of defects within a period of six weeks from today, if not already removed. The present petition stands disposed off on the aforesaid terms.
