The petitioners apprehend their arrest in Madhuban P.S. Case no. 5 of 2015, registered for the offences punishable under Section 366 and other Sections of the Indian Penal Code. The informant is the father of the victim, made allegation of kidnapping of his daughter Manisha Kumari against these petitioners, but Manisha Kumari appeared and made her statement under Section 164 Cr.P.C. and she disclosed that she voluntarily went along with Ajit Sahani and solemnized marriage with him. Her parents did not want to marry her with Ajit Sahani. The victim did not make any allegation.
Patna High Court Cr.Misc. No.16082 of 2015 (2) dt.28-04-2015 2/2 Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sikrahana at Motihari in connection with Madhuban P.S. Case No. 5 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
