JUSTICE ARUN KUMAR ORAL ORDER 26-04-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 5.3.2018, seek bail in Akbarpur PS Case No. 56 of 2018 registered under Sections 147, 341, 323, 448, 325 and 307 of the IPC.

The allegation in brief is that the petitioners assaulted informant side, specific allegation against petitioner no. 1 is of giving saif blow over head of the informant, Pradeep Yadav (petitioner no. 2) gave garasa blow on the person of Aalo Devi, Ramsharan Yadav assaulted Saroj Devi with iron rod and Nitish Kumar assaulted Hriday Kumar with sword on his head. Learned Counsel for the petitioners submits that there is case and counter case between both sides, corresponding injuries sustained by the so called injured persons are simple in nature except one injury attributed to Ram Saran Yadav and that is also on the non vital part of the body, none of the injuries are by sharp cutting weapon rather by the hard blunt substance and the petitioners have

Having considered the said facts and circumstances, the petitioners, namely, Ajay Yadav @ Rajendra Prasad @ Rajendra, Pradip Yadav, Ramsharan Yadav and Nitish Kumar are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of ACJM lst Nawada in connection with Akbarpur PS Case No. 56 of 2018.
