JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-03-2019 The petitioners seek bail in anticipation of their arrest in connection with Sherghati P.S. Case No. 647 of 2018 dated 29.11.2018 instituted for the offences under Sections 341, 323, 307, 354, 34 of the Indian Penal Code.
The petitioner No. 1 is the own brother of the informant whereas petitioner No. 2 is co-brother of petitioner No. 1. Both the petitioners are alleged to have assaulted the informant and his wife. However, the injuries reported on their persons are opined to be simple.
There is a complaint case also lodged by the
Patna High Court CR. MISC. No.16495 of 2019(2) dt.15-03-2019 2/2 wife of petitioner No. 1 against the informant of the present case. A petition also has been given by the villagers to the Superintendent of Police, Gaya intimating that because of inter-se dispute between two brothers, several cases have been filed against each other. Regard being had to the background facts and the relationship of the parties, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Sherghati P.S. Case No. 647 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Shageer/- U T
