The petitioners seek regular bail in connection with Nokha P.S. Case No. 330 of 2022, registered for the offence punishable under Sections 30(a), (c) and (d) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioners. Similarly situated co-accused have been granted bail vide order dated 06.01.2023 passed in Cr.

Patna High Court CR. MISC. No.19872 of 2023(2) dt.10-05-2023 2/2 Misc. No. 69508 of 2022. Petitioners are in custody since 04.02.2023.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioners, their period of custody, this application is allowed.

Let the petitioners, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court-2-cum-Additional District and Sessions Judge, Rohtas at Sasaram, in connection with Nokha P.S. Case No. 330 of 2022.
