This is an application for bail in connection with Jehanabad P.S.Case No. 353 of 2017 registered for the offences punishable under Section 30(A) of Bihar Excise Act. Allegation is of recovery of huge quantity of liquor from vehicle and petitioner was arrested at the spot. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and nothing has been recovered from his possession and he is in custody since 6.6.2017 having no criminal antecedent.

Having heard both sides and in view of facts and circumstances, the application is disposed of with a direction to

Patna High Court Cr.Misc. No.44251 of 2017 (2) dt.15-09-2017 2/2 the court below that once charge has been framed in this case or petitioner completes four months period in judicial custody, whichever is earlier, the court below will release the petitioner on bail to its own satisfaction, if application for bail is filed on behalf of petitioner.
