Mr.Prem Kumar Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-04-2019 The petitioner apprehends his arrest in connection with Saraiya P.S.Case No. 202 of 2018 registered under Sections 304B/34 of the Indian penal Code.

Allegation against the petitioner, who happens to be husband, is of dowry death.

Submission of learned counsel for the petitioner is that during course of investigation, villagers have told the police tht petitioner was living outside to earn livelihood and Chandan Kumar used to outrage the modesty of the deceased and for that she has committed suicide and as such petitioner has falsely been implicated in this case.

Heard learned APP also who has opposed the prayer for bail on the ground that statements of witnesses, who are relatives of the victim, have supported the case of demand and

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
