2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) , 41 ( 2 ) (1) of the Bihar Prohibition and Excise Act.
3 . Prosecution case is that 30 liters country made liquor were recovered from seized car of this petitioner.
4. It is submitted that the petitioner is innocent and
Patna High Court CR. MISC. No.14794 of 2025(2) dt.03-03-2025 2/3 has falsely been implicated in this case merely because he happens to be the owner of the seized car. Petitioner has no knowledge that his car is being misused in carrying illegal country made liquor because at the relevant time petitioner was at Kolkata . Much prior to the registration of the present FIR, petitioner had already sold the seized car to one Taushif Rahman son of Nabibar rahman . This petitioner by way of application dated 26.03.2023 has informed the Deputy Commissioner of Police Traffic department Lal Bazar Street Kolkata with regard to sale of his Car bearing Reg. No. WB26C - 7783 to one Md. Taushif i. e,. Annexure - 2 to the bail petition . No incriminating material has been recovered from the conscious possession of the petitioner.
Petitioner claims clean antecedent. 5 . Learned counsel for the State submits that the huge quantity of liquor have been recovered from the seized car of which petitioner is registered owner. Till date the transfer receipt of seized car has not been issued in favour of so called Tausif Rehman and petitioner is registered owner of the seized vehicle and hence he cannot escape the responsibility.
6. Considering the facts of the case as also the fact that huge quantity of liquor have been recovered from the vehicle of which petitioner is registered owner, prayer for
