JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2015 The petitioners are apprehending their arrest in connection with Bausi P.S. Case No. 114 of 2014 for the offences instituted under Sections 147, 341, 316, 379 and 354 of the Indian Penal Code.

Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that on 4.11.2014 at 2 P.M. his daughter-in-law Asha Devi had gone to see the paddy field, when she reached there then saw that accused persons Nandu Rishideo, Chanari Devi, Rinki Devi, Chandani Devi, Sunita Devi, Rangan Kumari and Sonal Devi were destroying the paddy crop. On objection, they brutally assaulted to Asha Devi due to which she became unconscious and due to that she

Patna High Court Cr.Misc. No.20576 of 2015 (2) dt.02-07-2015 2 / 2 miscarriage of her five months' pregnancy. It is further alleged that ornaments were also lost in that occurrence. It has been submitted on behalf of the petitioners have got no criminal antecedent. It is further submitted that as per F.I.R. the alleged date of occurrence is 04.11.2014 and the F.I.R. was instituted on 08.11.2014 with delay of four days. It is further submitted that the prosecution has not explained the delay. It is further submitted that no specific allegation has been made against the petitioners.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the facts aforesaid, let the above named, petitioners, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Bausi P.S. Case No. 114 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M.
