The petitioners apprehend their arrest in connection with Begusarai (Mufassil) P.S.Case No.354 of 2014 registered under section 307 and other sections of the Indian Penal Code. As per FIR, it is alleged that when the informant was going to his residence, accused Ramzani, Md. Karim, Md. Zainul, Md. Qudus, Md. Saddam, Md. Adalat, Md. Mister, armed with lathi, rod and knife, surrounded him and said that his nephew Manzoor who had instituted case and due to this cause, Azad is in jail and police is disturbing them, the accused persons asked them to withdraw the case. He also told that informant is not ready to compromise the case, so kill him, informant tried to flee away, but could not succeed. Md. Adalat assaulted him with rod on his head with intention to kill him which hit on the nose of the informant.
Patna High Court Cr.Misc. No.21492 of 2015 (3) dt.09-07-2015 2/2 Ramdhani assaulted with fist on mouth, accused Md. Karim wrapped gamchha in his neck and started twisting It has been submitted on behalf of the petitioners that the main allegation is against Md. Adalat, who has already been arrested and is in custody. Further, it is submitted that due to previous enmity, the petitioners have been made accused in the present case. It s also pointed out that prior to the present case, Begusarai (Mufassil Lakho, O.P.) P.S.Case No. 299 of 2014 was instituted against the informant of this case. On behalf of the State it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts that main allegation is against co-accused Md. Adalat, the petitioners, named above, in the event of their arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on their furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Begusrai (Mufassil) P.S.Case No.354 of 2014, subject to condition as laid down under section 438(2l of the Cr.P.C.
