This is an application for bail in connection with Sessions Trial No. 12 of 2017, arising out of Pothia P.S. Case No. 124 of 2016, registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.
Allegation against the petitioner is of causing death of the deceased.
Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence and he has falsely been implicated in this case and he is in custody since 7.9.2016. Further submission is that out of nine witnesses seven have been examined in this case.

No.45824 of 2017 (3) dt.07-11-2017 2/2 Having heard both sides and in view of facts and circumstances, as stated above, this application is disposed of with a direction to the trial court to expedite the trial and try to conclude it within a period of three months. At the same time, Superintendent of Police, Kishanganj is directed to ensure the presence of the remaining witnesses in court on the date fixed. This order must be strictly complied by the trial court and the Superintendent of Police.
