JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-11-2019 Learned counsel for the petitioner submits that the name of the petitioner was placed at serial no. 2 in the final select list for the grant of licence of Public Distribution System Shop in Gram Panchayat Arai. It is submitted that one Sintu Kumari (respondent no. 8) was placed at serial no. 1 and has been granted licence even though she happens to be the daughter of the village Basar and had been married about 15-17 years back in village Shahajpura, Panchayat -

Patna High Court CWJC No.5621 of 2019(2) dt.07-11-2019 2/3 Oro, Block Nardiganj in the district of Nawada, where her name is also entered into voter list.

Learned counsel submits that the petitioner has submitted an objection/representation before the District Magistrate, Gaya, copy of which is available at Annexure '3' series. He has also brought to the notice of this court letter no. 2058 dated 20.12.2018 as contained in Annexure '6' to the writ application written by Sub-Divisional Officer, Nimchak Bathani, Gaya to the District Magistrate, Gaya in which he has recommended for review of the selection of private respondent in the given facts and circumstances which have been discussed by him in Annexure '6'. Learned counsel for the State submits that keeping in view Annexure '3' series and Annexure '6' to the writ application, the District Magistrate, Gaya (respondent no. 3) may be directed to take an appropriate view of the matter after hearing the parties.

In the given facts and circumstances of the case, this writ application is being disposed off with a direction to the District Magistrate, Gaya (respondent no. 3) to look into the grievance of the petitioner, consider Annexure '3' series

Patna High Court CWJC No.5621 of 2019(2) dt.07-11-2019 3/3 and Annexure '6' to the writ application and pass an appropriate order after hearing the petitioner as well as private respondent no. 8.

Let the whole exercise in this regard be completed within a period of four months from the date of receipt/production of a copy of this order.
