The petitioner seeks bail in a case registered for the offence under Sections 406 and 120 of the Indian Penal Code and Section 138 N.I. Act.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the petitioner paid Rs. 30 Lakh to the BSFC through several cheques against the agreement between them and there is breach of agreement at the instance of the prosecution and in order to save their skin, they have lodged this false case against the petitioner.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st, Class, Special Court, Darbhanga in connection with Nagar P.S.
