The petitioner apprehends her arrest in a case registered for offences punishable under Sections 7(1)(A)(ii) of Essential Commodities Act.

As per the allegation, the petitioner had sold spurious fertilizer to the informant.

It is contended on behalf of the petitioner that the First Information Report has been lodged even after returning the cost of fertilizer. The sample of the fertilizer, which was collected, was sent for the test and the report contained in Annexure 4 shows that the sample is according to the specifications. The petitioner claims that she is having clean

Having regard to the facts and circumstances of the case as well as the fact that the petitioner is a lady, let the petitioner, namely, Smt. Shobha Devi, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Supaul P.S. Case No. 571/2015, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
