07-05-2018 Heard Sri Rajani Ranjan Pd. Singh, learned counsel for the petitioner and Sri Anuj Kumar Srivastava, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 01-12-2017 in Sahar P.S. Case No. 105 of 2017 registered for offence under Section 379 of the Indian Penal Code, has prayed for grant of bail.

Learned counsel for the petitioner submits that save and except so-called confessional statement of the petitioner, there is no other material to connect the petitioner in the present case. It has been argued by learned counsel for the petitioner that since petitioner was earlier involved in other cases, he was apprehended by the police and forcibly word of confession was put in the mouth of the petitioner and he is languishing in jail

Patna High Court Cr.Misc. No.27780 of 2018(2) dt.07-05-2018 2/2 since then.

Considering the nature of accusation as well as fact that petitioner has made accused on his own confession, let the petitioner namely Santosh Samrat @ Sunny be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhojpur at Ara in connection with Sahar P.S. Case No. 105 of 2017.
