Petitioner who is the husband apprehends his arrest in connection with Complaint Case No. C-1285 of 2019 registered for the offencs punishable under Sections 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. As per the prosecution case, the marriage of this petitioner took place in the year 2015 and there is allegation of demand of dowry and torture against this petitioner. In spite of notice, no one appears on behalf of opposite party No. 2.
It is submitted on behalf of the petitioner that
Patna High Court CR. MISC. No.16202 of 2020(6) dt.19-02-2021 2/2 petitioner is the husband and there is no such demand of dowry. It is further submitted that the petitioner is ready to keep his wife with full honour and dignity.
In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate (Sadar), Motihari, East Champaran in connection with Complaint Case No. C-1285 of 2019, subject to the conditions as laid down under Section 438
(2) of the Cr.P.C.
