At the outset, learned counsel appearing for the Bank has apprised the Court that SARFAESI application filed by the petitioner is pending before the Debts Recovery Tribunal. We are of the considered view that as the jurisdiction is vested in the Tribunal, the petitioner can raise all his grievance before the Tribunal, which is now functional.
