JUSTICE ARUN KUMAR ORAL ORDER 03-05-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 13.11.2017, seek bail in Siwan (Thawe) Rail PS Case No. 123 of 2017 registered under Sections 20 and 22 of the NDPS Act.

The allegation in brief is that the three petitioners were traveling in a train and the escort party found them carrying three bags, each bag containing 120 Kilograms of ganja. It is contended that recovery is not from possession of the petitioners, the packets were kept under the seat, the petitioners had no knowledge, none of the petitioners has criminal antecedent and charge has also been framed against the petitioners. Having considered the said facts and circumstances, the petitioners, namely, Seejan Yadav @ Srijan Yadav, Radha Devi and Roshni Devi are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of lst Additional Sessions Judge, Siwan in connection with Siwan (Thawe) Rail PS Case No. 123 of 2017.
