Petitioner apprehends his arrest in connection with Kishanganj P.S. Case No. 540 of 2016 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code. Allegation as per FIR the petitioner is that one Tata Magic vehicle was intercepted and 1.6 quintals of copper wire were recovered from the vehicle.

Submission of learned counsel for the petitioner is that he is driver of the vehicle and he has falsely been implicated only on the basis of suspicion.

Having heard both sides and in view of the facts and circumstances, I am not inclined to grant privilege of anticipatory

Patna High Court Cr.Misc. No.20691 of 2018 (2) dt.26-04-2018 2/2 bail, rather petitioner to surrender and make prayer for regular bail which will be considered on its own merit, without being prejudiced by the order of this Court.
