The petitioner seeks bail in a case registered under Sections-420, 379,411, 413 of the Indian Penal Code. Allegedly, a motorcycle was sold to the informant by the accused/petitioner which was later on, found to be a theft motorcycle.

It has been submitted that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-08-2022. He has remained in custody for about eight months. Charge sheet has already been submitted in this case. The trial is not likely to be concluded in near future. As per allegation, the petitioner is alleged to have

Patna High Court CR. MISC. No.15215 of 2023(2) dt.01-05-2023 2/2 sold his motorcycle to the informant which is alleged to be a stolen motorcycle. The petitioner denies the allegation of selling the motorcycle. The petitioner has been implicated in the present case due to ulterior motive.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Court below/concerned Court in connection with K. Hat P.S. Case No. 539 of 2022.
