JUSTICE SUDHIR SINGH ORAL ORDER 16-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Madanpur P.S. Case No. 121 of 2013 for the offences instituted under Sections 341, 323 and 354/34 of the IPC. The prosecution story, in brief, is that on 04.08.2013 at 1.00 P.M., the informant had gone to call of nature. In the meantime, the petitioner met and caught her hand. The informant made alarm, then Baleshwar Yadav, Anuj Kumar Yadav and Maniya Devi reached there and rescued her and this petitioner fled away and thereafter this petitioner came armed with Lathi alongwith Nagendra Singh and Dilip Singh and all the three persons started beating the informant causing injuries to the

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He has falsely been implicated in the present case. Due to petty dispute between the parties a false case has been instituted against him. From perusal of Annexure-2, it is evident that the matter has been compromised between the parties.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Madanpur P.S. Case No. 121/2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
