In this case, the petitioner is apprehending his arrest in connection with Mejorgunj P.S. Case No. 458 of 2018 registered for offences under sections 272/273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per First Information Report, the police has recovered 900 liters of Nepali Saufi wine from the Victa Sumo vehicle.

Looking to the quantity of wine recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the

Patna High Court CR. MISC. No.14989 of 2019(2) dt.12-03-2019 2/2 petitioner, above named, is rejected.

If the petitioner would surrender before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will take decision in accordance with law.
