JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner seeks bail in connection with Banka (Barahat) P.S. Case No. 494 of 2019 instituted for the offences under Sections 30(a), 32(2) of the Bihar Prohibition & Excise Act, 2016.

95.75 litres of liquor is said to have been recovered from a tempo of which the petitioner is owner and driver. The petitioner does not appear to have been arrested on the spot.

It appears that the tempo from which recovery has been made was found parked by the side of the road.

The allegation is that on seeing the police party,

The petitioner is in custody since 30.01.2020. However, considering the aforenoted facts viz. the period of custody of the petitioner and he being a person of clean antecedent as well as nature of accusation, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Banka in connection with Banka (Barahat) P.S. Case No. 494 of 2019.
