JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Beldaur P.S. Case No. 139 of 2016 instituted for the offence under Sections-366A/34 of the Indian Penal Code.

It has been submitted that the victim girl in her statement recorded u/S 164 of the Cr.P.C. has stated that she has solemnized marriage with this petitioner. She has stated her age as 16 years whereas; the court below has assessed her age to be 17 years. In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Beldaur P.S. Case No. 139 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Khagaria subject to condition that both the bailors should be close relative of the petitioner.
