Petitioner, already in custody, seeks bail in connection with Araria PS Case No.689 of 2017, registered under Sections 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that the only material against the petitioner is disclosure of his name by a co-accused Badal Kumar Mallik in his confessional statement, however no incriminating article was recovered from his possession.

Having considered the aforesaid facts and circumstances, petitioner Akshay Kumar Mallik @ Akshay Mallik is directed to be released on bail after framing of the charge on furnishing bail bond of Rs.10,000/- (ten thousand)

Patna High Court Cr.Misc. No.26228 of 2018(2) dt.03-05-2018 2/2 with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Araria PS Case No.689 of 2017.
