Pursuant to the notice issued to opposite party no. 2 for cancellation of bail, as granted by this Court, opposite party no. 2 has appeared.

From the records, it appears that this Court was made to believe that in the application for grant of bail in anticipation of arrest as filed on behalf of inter alia opposite party no. 2, it was stated that he has no criminal antecedent. With reference to paragraph - 4 of the present application, it was stated that opposite party no. 2 was accused in four cases which fact was not disclosed.

Patna High Court Cr.Misc. No.20349 of 2015 (4) dt.10-02-2016 Learned counsel for the opposite party no. 2 points out that, so far as the first case referred to in paragraph - 4 of the year 1997 is concerned, that stood concluded long back. So far as the second case is concerned, it is the case in question. So far as third and fourth cases are concerned, as the dates themselves would show they were the cases lodged much later after the present case and even after the application had been filed in this Court, and therefore, the statement as made in the application earlier filed was not incorrect.

Having considered the matter, it seems that the submission is incorrect. That being the position, this application is dismissed.
