The petitioner seeks bail in a case registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 90 litres Nepali Saufi Wine were recovered from the agricultural field of Pramod Mandal. It is further contended that petitioner has been named in the F.I.R. on the basis of confessional statement of accused persons. It is urged that on the basis of confessional statement of the petitioner, 106.350 liters Nepali Saufi Wine were recovered from the house of Kameshwar Mandal. It is further urged that there is no recovery from the conscious

Patna High Court Cr.Misc. No.36098 of 2017(2) dt.10-08-2017 2/2 possession of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 02.06.2017. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J. 1, I/C Special Judge (Excise Act), Sitamarhi in connection with Riga P.S. Case No. 157 / 2017. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
