The petitioner is in custody in connection with Sessions Trial No. 637 of 2018, arising out of Hasanpur P.S. Case No. 165 of 2008, registered for the offence punishable under Sections 147, 148, 149, 302, 120 (B) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel appearing on behalf the petitioner submits that after completion of the investigation police has submitted final form in favour of the petitioner on 1.8.2012. Later on, cognizance has been taken in the present case. He submits that petitioner is in custody since 12.11.2018.

No.14200 of 2019(2) dt.07-03-2019 2/2 Considering the fact that after completion of the investigation police has submitted final form and petitioner has no criminal antecedent, the Court is inclined to grant bail subject to the conditions, that petitioner will not in any manner tamper with the evidence, and he will extent full cooperation in the completion of the trial and in the event if he found in terrorizing the witnesses or causing the delay of trial, the Court below shall be at liberty to cancel the bail bond of the petitioner. Let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Addl. District and Sessions Judge 1st Rosera, Samastipur in connection with Sessions Trial No. 637 of 2018, arising out of Hasanpur P.S. Case No. 165 of 2008. (Anil Kumar Upadhyay, J) T.Kr./- U T
