Counsel for the petitioner submits that there is a case and counter case between the petitioner and his opponent bearing Khusrupur P.S. Case No. 164 of 2019 and Khusrupur P.S. Case No. 168 of 2019.

Counsel for the petitioner submits that the Khusrupur P.S. Case No. 164 of 2019 is awaiting for completion of investigation, whereas investigation in Khusrupur P.S. Case No. 168 of 2019 has been completed.

Patna High Court CR. WJC No.500 of 2023(2) dt.28-04-2023 2/2 Counsel for the State submits that in this matter, petitioner may represent before the Senior Superintendent of Police, Patna.

Counsel for the petitioner is directed to represent himself before the Senior Superintendent of Police, Patna as well as before the learned Chief Judicial Magistrate, Patna in the light of order passed in Surendra Singh Vs. The State of Bihar & Ors. in Cr. WJC. No. 153 of 2017 and analogous cases decided on 09.09.2022.

In this view of the matter, the present criminal writ petition is disposed off with direction to the petitioner to file representation before the Senior Superintendent of Police, Patna in the light of the order passed in Surendra Singh Vs. The State of Bihar & Ors. in Cr. WJC. No. 153 of 2017 with analogous cases decided on 09.09.2022 within thirty days from today and the Senior Superintendent of Police, Patna shall consider the representation and take appropriate action and if the petitioner not satisfied with the said investigation, he may pursue this matter before the learned Chief Judicial Magistrate, Patna in this regard who shall take appropriate action in this matter.
