Petitioner seeks bail in connection with Case No. C2/228/17 for offences punishable under Section 30(A) of the Bihar Excise Act.
The prosecution case, as lodged by the excise officials, is that they caught the petitioner near Indo-Nepal Border carrying 18 litres of Nepali Sophy wine in his bicycle. Accordingly, a seizure-list was prepared.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and is languishing in custody since 12.04.2017. He further submits that charge-sheet has already been submitted and there is no allegation
Patna High Court Cr.Misc. No.47124 of 2017 (2) dt.22-09-2017 2/2 of tampering of the prosecution witnesses by the petitioner. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Sitamarhi, in connection with Case No. C2/228/17.
