JUSTICE RAKESH KUMAR ORAL ORDER 04-05-2018 Heard Sri Pramod Kumar Verma, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Warisaliganj P.S. Case No.271 of 2017 registered for the offence under Sections 365/ 366(A)/34 of the Indian Penal Code, has prayed for grant of bail Learned counsel for the petitioner has drawn my attention to the impugned order, whereby the prayer for bail of the petitioner was rejected. He submits that the victim during investigation was examined under Section 164 of the Code of Criminal Procedure and in her statement, she herself stated that she fled away with the petitioner and married with him and she was carrying pregnancy of three months. She had disclosed her age as 19 years.

No.26503 of 2018(3) dt.04-05-2018 2/2 Considering the statement of the victim recorded under Section 164 of the Code of Criminal Procedure, there is no reason to detain the petitioner even for a moment. Accordingly, let the petitioner, namely,Kanhaiya Kumar Tanti be released on bail on furnishing bail bond of Rs.10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate- 2nd , Nawada in connection with Warisaliganj P.S. Case no.271 of 2017.
