JUSTICE SUDHIR SINGH ORAL ORDER 30-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 498(A) and other allied Sections of the Indian Penal Code.
The allegation against the petitioner is of assaulting and torturing the informant for non fulfillment of additional demand of dowry.
It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. It is further submitted that the petitioner is ready to keep the informant as his wife with full dignity and honour.
On behalf of the State and informant, it is
Patna High Court Cr.Misc. No.21722 of 2015 (3) dt.30-07-2015 2/2 submitted that the informant is ready to live with the informant. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhubani in Ladniya P.S.Case No. 99/14 (G.R.No. 2223/2014) (T.R.No. 4759 of 2014),subject to the conditions as laid down u/s 438(2) Cr.P.C.
It is directed that the petitioner and the informant shall appear before the court below and on being satisfied that both have agreed to stay together then the provisional bail granted to the petitioner shall be confirmed.
If the said effort fails then the petitioner shall deposit an amount of Rs. 2000/- (two thousand) per month in the court below which shall be released in favour of the informant. With the aforesaid direction, this application is allowed. (Sudhir Singh, J) singh/- U T
