JUSTICE ARUN KUMAR ORAL ORDER 07-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 7.3.2018, seeks bail in Gardanibagh PS Case No. 77 of 2018 registered under Sections 417 and 420 of the IPC.

The allegation in brief is that LTI of the petitioner in the biometric attendance machine did not match while he appeared in the written examination and subsequently during physical test. Learned Counsel for the petitioner submits that merely on the basis of report of the Agency of the biometric machine service provider FIR has been lodged but there is no expert view in this regard up till now and the petitioner is in custody since 7.3.2018. Having considered the said facts and circumstances, the petitioner, namely, Shashi Abhishek is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM -cumSub Judge XIV Patna in connection with Gardanibagh PS Case No. 77 of 2018.
