2. After some arguments, counsel for the petitioner

Patna High Court CWJC No.5043 of 2020(2) dt.29-03-2024 2/2 submits that he has already filed an application before the DPO, Motihari, East Champaran bearing No.03 of 2023 during the pendency of the writ petition, against the illegal appointment, which is still pending.

3. Counsel for the State submits that counter-affidavit has not been filed in this case though the order could not be passed only due to pendency of the writ petition.

4. In the present facts and circumstances, the present writ application is hereby disposed off, directing the petitioner to file this order passed by this Court before him and DPO, Motihari, East Champaran is directed to pass final order on the case of the petitioner within 90 days from the date of production of the order. Since general election of Lok Sabha, 2024 has been notified, therefore, 90 days shall be counted after end of the election.
