JUSTICE SUDHIR SINGH ORAL ORDER 16-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 148, 149, 341, 323, 325 and 307 of the Indian Penal Code.
Allegation is that accused persons including the petitioner were taking a procession of Saraswati Idol immersion, Informant made a protest for singing some indecent song by the accused persons. Thereafter, the accused persons including the petitioner assaulted informant and others who came to rescue him. Informant received cut injury in course of assault. It is submitted on behalf of the petitioner that he has got no criminal antecedent. No specific injury has been attributed against the petitioner. General and omnibus allegation has been made against all the accused persons including the petitioner. From perusal of the injury report it appears that injury no. 2 is simple in nature. As far as injury no. 1 is concerned, opinion has been reserved. It has further been submitted that no final opinion in respect to injury no. 1 could come on the record because the x-ray report of the informant in respect to injury no. 1 has not been

On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Town P.S. Case no. 56 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
