Allegation against the petitioner is of causing death of his brother-in-law (Sala) and earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 7.7.2017 passed in Cr. Misc. No.24012 of 2017 with a direction to the learned trial court to conclude the trial within a period of nine months and liberty has been given to the petitioner to renew his prayer for bail.
Submission of the learned counsel for the petitioner is that there is no direct allegation against him and he has been made accused only on the basis of suspicion and up-till-now out of 15 witnesses only 06 witness has been examined and there is no likelihood of the conclusion of trial in near future and the
Patna High Court Cr.Misc. No.30462 of 2018 (2) dt.17-05-2018 2/2 petitioner is in custody since 14.12.2016.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Bagaha, District West Champaran in connection with S.Tr. No.144 of 2017 arising out of Bagaha P.S.Case no.469 of 2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
