The petitioner seeks regular bail in connection with Mairwa P.S. Case No. 110 of 2017 registered for the offences punishable under Sections 341, 323, 379, 307 and 504/34 of the Indian Penal Code.
It has been alleged that altogether five accused persons named in the F.I.R. allegedly assaulted the informant and his family members. The occurrence of scuffle took place when the informant started constructing facia of his house. Except this petitioner, four persons have been allowed by the learned Sessions Judge. The allegation against this petitioner is that he assaulted the informant and his father by iron rod. The
Patna High Court Cr.Misc. No.43757 of 2017 (2) dt.20-09-2017 2/2 injury report annexed with the petition shows that the brother of the informant, namely, Sharda Gond sustained lacerated injury on head and chin. The petitioner is in custody since 30.04.2017, having clean antecedent.
The learned APP for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate-VII, Siwan in connection with Mairwa P.S.
