The petitioner seeks regular bail in connection with Siswan (Chainpur O.P.) P.S. Case No.06 of 2018 registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

The allegation as per the F.I.R. is that the petitioner and other accused persons having been found to be fleeing away and upon being apprehended and search being made, some cash and ornaments were found from their possession. It has been submitted that the petitioner is a neighbour of the informant and he has been falsely implicated in this case. Nothing has been recovered from conscious possession of the

No.31082 of 2018 (3) dt.09-07-2018 petitioner rather during course of investigation a sum of Rs.1000/- and two silver bangles were found regarding which it is submitted that the same belongs to the petitioner herein and are not the stolen articles. It has been submitted that no T.I. Parade has been held till the date. The co-accused Sanjay Chaurashiya has been allowed bail by one of the coordinate bench of this court in Cr.Misc.No.23731 of 2018. The case of this petitioner stands on similar footing. He is in custody since 09.01.2018 and so he deserves bail.

The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M. X, Siwan in connection with Siswan (Chainpur) P.S. Case No.06 of 2018. (Sanjay Kumar, J) Harish/- U
