Patna High Court CR. MISC. No.16373 of 2019(2) dt.15-03-2019 2/3 This application, for grant of anticipatory bail, arises out of Marhowrah Police Station Case No. 601 of 2018, disclosing offences under Sections 147, 148, 149, 379, 435, 436, 427, 506 and 504 of the Indian Penal Code.
Learned Counsel appearing on behalf of the petitioners has submitted that there is general and omnibus allegation against 15 persons named in the First Information Report and 100-150 unknown, who are said to have set on fire the informant's household articles. They are said to have obstructed the fire fighting vehicle to control the fire. Learned Counsel appearing on behalf of the informant could not satisfy this Court that there is any specific allegation against any of these petitioners in the First Information Report. Considering the general and omnibus nature of allegation, this application is allowed.
Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VIII, Saran at Chapra, in connection with Marhowrah Police Station Case No. 601 of 2018, subject to the condition laid down under
Patna High Court CR. MISC. No.16373 of 2019(2) dt.15-03-2019 3/3 Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
