JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State and learned counsel for the complainant.

Petitioners apprehend their arrest in connection with Complaint Case No. 26824 ( C) of 2014 registered for the offences punishable under Sections 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

Petitioners are in-laws of the complainant.

No doubt, there is allegation that petitioner no. 2 pushed the complainant from the stair on 12.9.2013 as a result of which the complainant sustained injury and got treated herself in clinic of private doctor. The complainant produced some prescriptions and X-Ray report before inquirying court at the time

No.21361 of 2015 (3) dt.03-07-2015 2/2 of taking cognizance of the offence as reported by the court below but even if the aforesaid prescriptions and X-Ray report are assumed to be true, then also, no injury was found on person of the complainant. Moreover, the allegations of demand centers around the husband of the complainant.

Accordingly, it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Complaint Case No. 26824 ( C) of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
