Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 307, 498A/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The basic accusation is of torture.
It is alleged that in-laws family including the petitioner who was neighbour of the husband of the informant made an attempt to kill the informant by setting the informant on fire. Subsequently the informant succumbed to the injuries. It is submitted by learned counsel for the petitioner that petitioner is neighbour of the husband of the informant and there is nothing to do with the internal affairs of the husband of the informant.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.21911 of 2015 (2) dt.25-06-2015 2/2 informant that petitioner has purchased half portion of the inlaws house of the informant and the husband of the informant had illicit relationship with the daughter of the petitioner, as a result she participated in the commission of the occurrence. Considering the fact that informant has named the petitioner as a person who participated in causing burn injury to her, this Court is not inclined to grant bail to the petitioner.
Accordingly the application is dismissed in connection with Malsalami P.S. Case No. 32 of 2015, G.R. No. 358 of 2015.
