The petitioner seeks regular bail in connection with Beur P.S. Case No. 149 of 2017 registered for the offence punishable under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The allegation in brief is that the informant's husband was killed while he had gone for some work outside the village and suspicion was raised that the co-accused persons including the petitioner herein had killed the husband of the informant with a motive of grabbing the property of the deceased. The learned counsel for the petitioner submits that except suspicion, there is no materiel to connect the petitioner with the alleged crime and the petitioner is having a clean
Patna High Court CR. MISC. No.17150 of 2019(2) dt.01-04-2019 2/2 antecedent as well as he is languishing in custody since 25.09.2018. Lastly, it is submitted that exactly similarly situated co-accused person has been granted regular bail by a coordinate Bench of this Court vide order dated 21.03.2018 passed in Criminal Misc. No. 15357 of 2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-VII, Patna in connection with Beur P.S. Case No. 149 of 2017.
