The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 327, 387, 386, 504 and 34 of the Indian Penal Code.
The informant alleged that the petitioner and his father have executed a deed of agreement to sale the land to the informant and the petitioner and his father received the entire consideration amount, but the petitioner did not execute the sale deed and has sold the land to someone else.
It is submitted that the petitioner never executed any deed of agreement to sale the land. The dispute is of civil nature. Having considered the facts aforesaid and the fact that the petitioner is alleged to have breached the terms and conditions

No.15437 of 2016 (2) dt.29-04-2016 2/2 of the agreement by not executing the sale deed and the dispute appears to be of civil nature, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jhanjharpur in Jhanjharpur P.S. Case No. 64 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
