JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Nabada Bazar (Rajoun) P.S. Case No. 16 of 2020, registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is of recovery of 33 bottles each containing 750 ml. Indian made foreign liquor from the Santro Car, which was being driven by the petitioner. Learned counsel for the petitioner submits that the petitioner is accused in two other cases, as detailed in paragraph 3 of the petition, due to that reason police implicated the petitioner in the present case and in the present case, he is in custody since 10.01.2020.

No.15740 of 2020(3) dt.14-05-2020 2/2 Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.5,000/-(Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Banka, in connection with Nabada Bazar (Rajoun) P.S. Case No. 16 of 2020. Out of two sureties, one surety must be the close relative of the petitioner.
